Minutes of the Court of Pleas and Quarter Sessions
Bute County, North Carolina 1767-1779

 

 

        Bute County was formed in 1764 from Granville County. Court records exist from 1767 until 1779, when the territory was divided to form Warren and Franklin Counties. Lists of deeds proved and recorded are found in the court minutes, as well as lists of wills proved or administrations on intestate estates. The construction of roads and the road juries who were to lay out and maintain the roads are included in these records, as well as court cases, depositions, petitions and jury lists. Following are just a few of the many records found in these court minutes.

 

 

1767

 

The Last Tuesday in October 1767

 

At an Inferior Court of Pleas & Quarter Sessions held for the County of Bute at the Court House at the Buffelow on the last Tuesday in October 1767. Present Osborne Jeffreys, William Johnson, Philemon Hawkins and Thomas Bell, Esq'rs.

A Deed of Bargain & Sale from Thomas Moseley & wife to William Kimbrough containing 300 Acres dated the 21st day of September 1767 proved by the Oath of Robert Moseley M. O. R.

A Deed of Bargain & Sale from Thomas Fox to Philip Alston for 172 Acres dated the 30th day of August 1767 proved by the oath of William Alston M. O. R.

Order'd that James Petty be appointed overseer of the Road in the rome of John Watkins.

Joseph Magee's Mark is a Crop & two slips in the right ear & a hole in the left M. O. R.

A Deed of Bargain & Sale from Joseph Williams to John Underwood for 290 acres dated the 24th day of October 1767 proved by the oath of John Strother M. O. R.

Robert Turnbull returned on Oath an Inventory of the Estate of Samuel Croxton Dec'd M. O. R. Order'd that the Sheriff sell the Estate of s'd Croxton the last Saturday in November 1767

William Yates proved his Attendance in the suit William Crutchfield vs. William Smith Pr Plt amounting to £ 1 8.

Order'd that Richard Davis Orphan of Thomas Davis dec'd aged about sixteen Years be bound unto John Strother to learn to read & write & learn the mistery of a Carpenter.

Order'd William Bailey an Aged & infirm person be recommended to the General Assembly as a proper person to be exempt from paying publick tax and performing other publick duties.2

The Court adjourned untill to Morrow morning 9 o'clock.

Order'd, that the Petition for a Road to be Open'd from out of the Road that Leads from the Court house to Mr. Callers Beginning Near about where Mr. William Neal keeps school Running the best & most convenient way by William Houses crossing fishing Creek near the said Houses running into the Road near William Birds new Road & that the following Jurors /to wit/ Charles Allen, John Jackson, Charles Burk, Peter Kimball, Jonathan Johnston, Jordin Harris, William Moore, Joseph Hackney, William Green, Benjamin Kimball, John Perdue Sen'r, William House, English Richard Moore, John Bell be appointed to lay out the s'd road the best & most convenient way & according to Law, & That the following hands /to wit/ Peter Greens, William Houses Gent. & James Moore do open & maintain the said Road under William House Gent. Order'd that the hands of William Neal work on the road under Thomas Christmas Overseer.

Order'd that George Brodgon be appointed Overseer of the road in the rome of William Martin.

Order'd that Edward Cary an Aged and Infirm person be recommended to the General Assembly of this Province as a proper person to be exempt from paying publick Taxes & Performing other publick Duties.

William Park produced a power of Attorney from Robert Crawford, Robert McLintock and C'o Merchants to the said Park which was proved by the Seal of the City of Glasgow & subscribed by the present Lord provost of the said City agreable to an Act of parliament made in fifth year of King George the second. The said power being dated the 4th day of June 1767. Order'd that the said Power of Attorney be admitted to record.

A Deed of Bargain & Sale from William Moore to Daniel Potter for 400 acres dated the 7th of September 1767. Ack'd. M. O. R.

Julius Nichols Esq'r produced a Commission from under the hand & seal of His Excellency the Governour dated the 19th day of May 1767 appointing him Sheriff for the County of Bute the ensuing Year; took the Oaths of Government subscribed the Test & took the Oath of a sheriff and enter'd into Bond with Benjamin Person, Thomas Bell, John Hawkins & William Moore securities approved of by the county.

Francis Capps appointed constable in the rome of Joshua Capps who was Qualified according to Law.

Order'd that Wm May be fined Nisi & be summond to appear to shew cause why he did not appear to next Court.

Benjamin Person C. Sur: return'd a plan of an Acre of Land by him surveyed for Francis Mabry & Likewise an half acre of Land of John Golden according to an order of last Court. M. O. R.

Green Hill, Benjamin Ward & Philemon Hawkins made a return of the valuation of an Half acre of Land the property of John Golden amounting to Twenty shillings Virginia money. M. O. R.

On Notice in Writing being given that Julius Nichols & others intend to make use of some place on the Land of William Moore for the publick Worship of God according to the practice of Protestants of the presbeterian Denomination; agreeable to the request of the subscribers thereto, Order'd that the said Notice &c be filed &c.6

May 13, 1768, A Deed of Bargain and Sale from William Ashley to Thomas Roland for 150 acres of Land was proved by the oath of Aaron Fussell, a Witness thereto, and on Motion the same is ordered to be register'd.

May 13, 1768, A Deed of Bargain & Sale from John Smart & wife to Mark Bennett, for two hundred Acres of Land, was proved by the oath of William Park a witness thereto, and on motion the same is ordered to be register'd.

Friday after the second Tuesday in February 1769, Ordered that the following persons to wit, Benjamin Ward, Nathaniel Henderson, Jethro Sumner, Philemon Hawkins, John Hawkins Jr., Thomas Cook, Edward Jones, Adkin McLamore, Young McLamore, Ephraim Estis, Thomas Estis, Daniel Barrow, Robert Ward, Robert William Sr., John Nicholson, James Milles, Charles Lyles and Irbin Nicholson, lay off and turn the road at or near where the Granville line crosses the road leading to the old court house, the best and most convenient way crossing Sandy Creek at the rock at the old road and so through the woods, on the north side of the widow Christmas's plantation the best and most convenient way into the old road below Wells' branch, and that the hands the formerly work't on the old work under Kedar Best in opening and putting the same in repair.

Wednesday after the second Tuesday in February 1769, On Motion James Bennett orphan of Richard Bennett came into Court and made Choice of Solomon Langston his Guardian, who with Francis Capps and Richard Bennett entered into and executed a bond for that purpose.

Second Tuesday in May 1769, A deed of bargain and sale from Robert Cheek and wife to Henry Cook proved by the oath of Thomas Estes a witness there and ordered to be registered.

Nov 15, 1769, The petition of Ephraim Estridge for a Water Grist Mill on Sandy Creek lyes over for hearing.

Nov 15, 1769, On the Petition of John Hawkins Jr., for a mill on Sandy Creek, the land on the opposite side being the property of Ephraim Estridge, ordered that Edward Jones, Thomas Cooke, Daniel Barrow and Charles Lyles in company with the county surveyor lay off and value one acre of land on each side the said creek where the petitioner intends to erect his said mill and report the same to the next court.

Nov 15 1769, On the petition of William Tabb for a mill on Sandy Creek, the land on the opposite side being the property of Philemon Hawkins, ordered that Edward Jones, Thomas Cooke, Daniel Barrow and Charles Lyles, in company with the county surveyor lay off and value one acre of land on each side the said creek where the petitioner intends to erect his said mill, as also the distance from that place to Ephraim Estridge's mill, and that they and report the same to the next court.

Nov 15, 1769, On the petition of Ephraim Estridge for a mill on Sandy Creek, the land on the opposite side being the property of John Hawkins, ordered that Edward Jones, Thomas Cooke, Daniel Barrow and Charles Lyles, in company with the county surveyor lay off and value one acre of land on each side the said creek where the petitioner intends to erect his said mill and report the same to the next court.

Feb 17, 1770, The petitions of John Hawkins, Ephraim Estridge and William Tabb about mills are continued until next court.

May 10, 1770, John Duke a Witness for Isham Parham against Peter Green and als made oath to his account for attendance amounting to one pound and seven pence proc.

May 10, 1770, James Egerton made oath to his account for attendance as a witness for Richard Parham against Len Henly Bullock amounting to £2.16.7 proc.

May 10, 1770, The petitions preferred to this court by John Hawkins Jr. and Ephraim Estridge for liberty to build a mill on Sandy Creek, having been fully heard, the court are of opinion that Ephraim Estridge be preferred, and that he have liberty and leave to rebuild his mill, and the freeholders Edward Jones, Thomas Cook, Daniel Barrow and Charles Lyles by order of this court appointed to lay off, view and value on oath, one acre of land the property of each party, in company with Benjamin Person Esq'r, the county surveyor, having returned their report of laying off and viewing the same valuing each at ten shillings proc., money, the said Ephraim Estridge paid down in court the said sum of ten shillings proc. for the said acre of land the property of the said John Hawkins Jr. agreeable to the Act of Assembly. Ordered that the said Ephraim have liberty to rebuild his said mill and that he be seized of the said acre of land formerly by the said John's agreeable to his said petition, and the said Ephraim at the same time paid down the costs of both petitions, and it is also ordered that the freeholders and surveyors report be recorded.

May 14, 1771, Ordered that Benjamin Ward, Philemon Hawkins, James Ransom, William Park, Edward Jones, Thomas Cooke, Adkin McLamore, Young McLamore, Isaac Hunter, John Hawkins Jr., Daniel Barrow, Ephraim Estridge, Aaron Fuzzel, Nathaniel Peebles, John Nicholson, James Milles, Jethro Sumner, Christopher Robinson and Mathew Duty lay off and turn the road formerly leading from Nathaniel Hendersons towards the court house beginning at or near the Henderson's mill path, and from there to continue over his mill tale, and from thence the best and convenient way to the court house, and that they report their said proceedings to the next court, this order to be continued till next court.

May 15, 1771, A Deed from Mark Bennett and Jemima his wife to Stephen Gupton was proved by the oath of James Gupton a witness and on motion the same is Ordered to be Registered.

May 15, 1771, A Deed from Sarah Nelms to Peter Goodwin was proved by the Oath of Mark Bennett a witness thereto and on Motion the same is Ordered to be Registered.

May 16, 1771, Ordered that Christopher Robertson, William Bagley, Izram Cogwell, Turner Harris, John Pownell, Robert Cheek, Nathaniel Peebles, Aaron Fuzzel, Thomas Estridge, Henry Cooke, Nathaniel Henderson, Urbaine Nicholson, James Arnold, Mathew Duty and Roger Thornton view the way for a road to be cleared beginning where Tabb Clantons path turns out of the Shocco Road the most convenient way by Nathaniel Peebles' plantation, thence a direct course up to the path that goes from Turner Harris to Ephraim Estridges, and that Nathaniel Peebles be overseer of the same and that he open the same with the hands belonging to Turner Harris, Izram Cogwell, John Pownell, Robert Cheek, Christopher Robertson, Thomas Norman and the hands of the said Nathaniel Peebles.

Feb 14, 1772, The sale of the Estate of Samuel Ely dece'd was returned into Court by Jonathan Davis sub Sheriff on Oath and ordered to be recorded.

Feb 14, 1772, The Inventory of the Estate of Hezekiah Massey dece'd was returned into Court by Lidia Massey on oath and ordered to be recorded.

Feb 14, 1772, James Martin guardian to Abigail Terrill returned into Court an account of his said guardianship to which he made oath and the same being examined by the Court is allowed and ordered to be recorded.

Feb 14, 1772, The Petition of Sundry Inhabitants for turning the road from the Burnt Ordinary to Col'o Thomas Eatons Ferry, the follow way to wit, that the road may Cross the Low Grounds at a place called the Reedy Swamp and from thence up the Ridge between Stone house and Hubb Quarter, until it intersects the road leading to Halifax town, the best and nearest way that may be, and ordered that James Nichols, William Derham, Henry Foote, James Jones, William Basser, Thomas Bell, Daniel Sledge, Moses Myrick, John Shearin, Robert Harris, Joseph Bell, Jordan Harris and Daniel Pegram view the most convenient way to open the same, and it is also Ordered the hands of Daniel Sledge, Joseph Shearin, John Meadows, James Jones, William Vasser, Thomas Read, William Derham, Mark Thornton and John Derham open and clear the same.217

Feb 14, 1772, Henry Hill and John Hawkins Esq'rs by virtue of a Commission of the peace and a Dedimus Annexed thereto took the oaths appointed to be taken by public Officers, repeated and Subscribed the Test and Also took the oath of a Justice of the peace in this County.

May Court 1774, Ordered that Adkin McLamore, Benjamin Kimball, Nathaniel Peebles, William Bagley, John Hawkins, Young McLamore, Roger Thornton, Joseph Hackney, Izrom Cogwell, William Clemmens, Nathaniel Henderson, Robert Williams, John Nicholson, Charles Allen, Thomas Cook, John Estes, Robert Childres, William Green, William House and Philemon Hawkins do lay off a road the best and convenient way from the mouth of Nathaniel Peebles road, to Colonel Hawkins road at or near the fork of nut bush road, and the hands of Benjamin Kimball, Philemon Hawkins, Young McLamore, John Nicholson, John Stokeley, Charles Cole, William Clemments, and Lahorn Thomas Norman, Nathaniel Peebles, Nathaniel Henderson and Sillus Jordan, open and clear the same and that Nathaniel Henderson be overseer of the same.
