1994
No one gets to ride the range with the Marlboro Man, not even pretty cowgirls. In 1994, Star Tobacco of Petersburg, Virginia, introduced their new "High Sierra Blend" and “Western Blend" Gunsmoke Cigarettes. Packaging featured a sassy looking cowgirl and a handsome dude who looked like he could be found in any saloon west of Laramie. Holy Smoke! That’s trademark infringement! Yep, Philip Morris, manufacturer of Marlboro Cigarettes, owns the MARLBORO COUNTRY advertising trade dress. This means a range war will be fought when any renegade ventures into that mythical land. Mr. Anthony L. Fletcher, a gunslinger with Fish & Richardson, a leading global law firm practicing in the areas of intellectual property, was hired to protect against this encroachment. The barbed wire fence that Fletcher built around Marlboro Country sent the two rustlers packing.
Star Tobacco wasn't the only firm that lawman Fletcher lynched. In 1974, there was a gunfight at the O.K. Corral when he successfully opposed registration of a cowboy photo label for PAUL REVERE EXTRA, a brand that Rembrandt Tobacco had made in Virginia by Larus & Bro.
